I tried to migrate my legacy account, which I already have done years beforehand, but I am not able to select or get the Microsoft Special Cape. Does anyone else have this issue? Or is this intentual?

No... it is about migrating to a Microsoft account, not from a Legacy Minecraft account to a Mojang account (which we currently have). Right now they have not started migration to the Microsoft account (afaik), but you will receive an email when you are able to do so.
